ICAC/ANU Corruption and=20 Anti-Corruption Executive Program:

This=20 program entitles ten people working within the NSW public sector to be = given=20 scholarships to attend a graduate course that offers in-depth study of = the=20 causes of corruption and effective corruption prevention=20 strategies.

Fraud=20 Control Revisited:

Being=20 the 10th year for the CPN also means that it=92s the 10th anniversary of = the NSW=20 Audit Office's popular guidelines on fraud control. Stephen Horne has risen to the = challenge=20 of marking this event by spending resources to revisit and update = these. Stephen says that is moving to = commission another follow-up performance audit to check out how things = are going=20 with this issue across the NSW public sector. The audit will extend to = developing an=20 updated better practice guide. =20 Maybe even some new cartoons! (The previous ones are available = from the=20 CPN website)

Australian=20 Standards:

The=20 CPN was represented in the project to develop the Australian Standard = 8000=20 series, which address a glaring weakness in the current governance = landscape:=20 the lack of a unified set of standards to cover all governance=20 jurisdictions. Those Standards have been designed to apply equally = well to=20 the private sector, public sector and not-for-profit sector. They = provide common=20 elements, and also allow for specific areas of difference. The Standards are in a suite, = and=20 provide a range of quite considerable challenges. Few = organisations would=20 currently score well across the full spectrum that the Standards = address. =20 So the Standards do not merely codify existing ideas of best practice, = but=20 provide targets to aim for. And very importantly, the Standards = emphasise=20 that governance is fundamentally about = accountability.

But=20 the work on governance goes on. Standards Australia has formed = further=20 working groups to develop additional related Standards and supporting = guidance=20 material. The CPN is again represented in this work, and in = particular on=20 the working group which Stephen Horne is leading to develop a Handbook = on=20 Disclosure and Transparency. One of the main consequences of = transparency=20 is that it promotes informed decision-making, promotes trust, and=20 diminishes corruption. = The=20 purpose of this Handbook is to support the development of best practice = in=20 corporate governance through strengthening the character of disclosure = and=20 transparency arrangements employed by Australian=20 organisations.

Standards=20 Australia:

For those=20 that have not yet looked at the suite of governance standards issued by=20 Standards Australia, there is a standard on whistleblowing giving strong = policy=20 support for whistleblowers. If the standard is fully adopted, it then = becomes an=20 issue of how willing an organisation=92s management is to implement that = support. Whistleblowing = management=20 is still in its infancy. = As such,=20 it is a difficult, daunting and harrowing task mainly due to the = emotionally=20 charged environment & diverse expectations of people involved.

It will be=20 interesting to see whether this area of management can mature and just = what that=20 maturity will bring. = Will it=20 become a more rational process that produces an early reporting work = culture=20 where whistleblowing becomes a standard expectation that receives = immediate=20 management action to limit both the financial impact and the emotional=20 fallout? Will there be = growth=20 beyond the Standard to ensure fairness by introducing high-level = management=20 support for individuals adversely accused (ie: support equivalent to that = provided=20 for whistleblowers) up until the allegations are determined as accurate = or=20 otherwise? Will grievance = management evolve to become more efficient, effective and responsive to = reduce=20 whistleblowing incidents? =20 Certainly, the boundaries will be tested and blurred during the = growth=20 phase.

In most=20 Australian government agencies (Commonwealth excepted), whistleblowing = policy=20 and procedure is determined by legislation. In some State & local = government=20 jurisdictions, the legal prescriptions do not capture all people that = work in an=20 organisation but limit it to public officers. Such agencies are thus = confronted with=20 legal imperatives that do not deal with all workers equally or = fairly. Adoption of the whistleblowing = standard=20 in full may alleviate this provided senior management is dedicated to = it. However, there is a real risk = and strong=20 likelihood that such dedication and commitment can be overturned in a = courtroom=20 or under threat of legal action.

Here is a=20 prediction: there will be friction.
